We Didn't Really Mean It - Walter Olson has noted that Virginia Attorney General (and erstwhile GOP gubernatorial wannabe) Jerry Kilgore issued n letter narrowly construing the import of the Commonwealth's new SuperDOMA. Since I can't find any recent opinions on the AG's website, its not clear whether this "letter" is even an official opinion, but regardless, Gilmore's advice does not bind any court to reach the same conclusion (although state agencies ignore them at their peril).

Oh, and in related case of backtracking, President George W. Bush has declared it "great" if states want to legally recognize gay relationships with civil unions. (Somehow I doubt that position is making it into the GOP platform this year.)
