According to the website, the gallery in question did not have captions or make any suggestions about the sexual orientation of those pictured, and the cameraman was a credentialed reporter covering the LA Marathon, a public event. One wonders, therefore, how did the litigious Mr. Harbinson suffer such "extreme embarrassment, public humiliation, mental agony and damage to his name and reputation"?
